A lawsuit againt Apple has been filed which alleges that the resin coasting on the surfact of the iPod nano is defective. And more importantly, that Apple knew about the defect but still shipped the lot.

iPod Nano consumers stated that they were misled by the Sales department implying that they are durable and won’t get scratched easily. Battery life of the iPod nano was also found malfunctioning. And on returning the product at the outlets to exchange for a new one, customers were charged US$25 as a return fee.

According to the proposed class action law suit- restitution for damages, including refunds for nanos and the $25 return fee, along with attorney’s and legal fees is being requested.

All of this directs to the deceptive and unlawful conduct in designing, manufacturing, distributing, and selling defectively designed portable, digital music players by Apple.
